Strengthened legislation for patients with reduced decision-making capacity in healthcare

The government has tasked the National Board of Health and Welfare with preparing legislative proposals to ensure that patients with impaired decision-making capacity have access to healthcare on equal terms with the rest of the population. The proposals must also safeguard legal certainty for both patients and healthcare professionals. The guiding principle of the regulation will be that the best interests of the patient should always prevail in healthcare decisions. The legislative proposals will be preceded by a thorough investigation and analysis of current conditions. Importantly, the proposals will not include compulsory legislation. The final report is to be submitted to the Government Offices (Ministry of Health and Welfare) in April 2027.
